Buying Policy

Legacy Americana is constantly in search of vintage campaign and cause memorabilia and presidential artifacts to serve an ever-expanding, international clientele of private collectors and institutions. Emphasis is placed on United States election-related ephemera, but any object of historical interest will be considered, and we love the unusual. Prospective sellers are encouraged to submit their material for consideration.

We are prepared to make competitive cash offers for important single items, select groups of items, and collections of any size. We will make an effort to assist you even if you haven't yet decided to sell. There is no obligation to sell, and there is no charge for your initial consultation.

When an item or collection is identified for possible acquisition, the prospective seller will be asked to provide as much descriptive information as possible, including images (e.g. photos, copies or scans). Do not, however, send any information not specifically requested. If sufficient information cannot be gathered remotely (in the case of large collections, etc.), we may request a viewing in person, either at the seller's residence, storage facility or place of business, Legacy Americana headquarters, or at another mutually agreed upon location. Each party shall be responsible for any travel or other expenses thus incurred.

When enough information has been gathered, and in our judgment a transaction appears viable, an offer will be submitted in writing, and is good for a period of 90 days. The seller may stipulate a price, which if agreeable will be the amount of our offer; if the seller's stipulated price is deemed too high, a counteroffer may be submitted, or the item(s) refused for acquisition. If we decline to make an offer, the seller will be informed of the reason and advised on alternative means of disposing of his or her property.

Sellers are encouraged to evaluate carefully any offer, and to seek qualified, independent advice if necessary. We are not appraisers, and no offer should be regarded as the equivalent of an appraisal or an estimate of market value. While an offer remains valid, sellers are at liberty to seek competing offers from other parties not affiliated with Legacy Americana.

After an initial free consultation, a prospective seller may be billed for further consultation and advice. For hourly rates, please refer to our Explanation of Rates. Whether a prospective seller is billed for consultation shall be at the discretion of Legacy Americana, and in most cases fees are waived if a transaction is in progress. After a successful transaction is completed, the seller will be entitled to a full refund of any consultation fees associated with said transaction.

We will not engage in "bidding wars" with other prospective buyers. Once an offer has been submitted, it should be considered firm and final. If our offer is rejected in favor of a competitor's, we ask that the seller inform of the fact immediately, so the file may be closed (our offer will remain valid for 90 days, however, even if rejected).

If satisfied with our offer, the seller must provide a written acceptance within 90 days. Item(s) to be sold are thereupon rendered to a Legacy Americana associate for final inspection and approval. In the case of large collections, final inspection will be performed on location. Otherwise, seller will be provided an address to which item(s) are to be shipped. DO NOT ship to Legacy Americana headquarters unless specifically instructed to do so.

Legacy Americana shall not be responsible for loss or damage that may occur during shipment. In addition to packing items with care, we strongly recommend insuring for full replacement value (or in the amount of the offer). We will advise sellers on how best to prepare items for shipment, and of the options for safe and reliable delivery. Sellers may qualify for a full or partial refund of the cost of shipping item(s) acquired by Legacy Americana; send under separate cover copies of any shipping-related receipts.

If upon inspection item(s) are found to differ materially from the seller's description, are determined to be reproductions or forgeries, are found to have damage or flaws not before apparent, or for any reason must be declined for acquisition, the offer will be rescinded or revised. If rescinded, item(s) will be returned promptly to the seller. If revised, seller will have a period of five (5) business days to accept or reject the revised amount; if rejected, item(s) will be returned.

Items approved for acquisition are considered sold at the agreed upon price, and payment in full shall be immediately forthcoming by terms agreeable to both parties (usually check or bank draft sent via certified mail). In addition to the purchase price, seller may be entitled to reimbursement of any consultation fees and transaction-related expenses (be sure to save all receipts).
