Consignment Policy

Legacy Americana is constantly in search of vintage campaign and cause memorabilia and presidential artifacts to serve an ever-expanding, international clientele of private collectors and institutions. Emphasis is placed on United States election-related ephemera, but any historical item will be considered, and we love the unusual. Prospective sellers are encouraged to submit their material for consideration.

We accept consignments of important single items, select groups of items, and collections of any size. Our experts will make an effort to assist you even if you haven't yet decided to sell. There is no obligation, and there is no charge for your initial consultation.

Legacy Americana offers consignors a variety of options for marketing their political collectibles and presidential artifacts. We don't believe in a "one-size-fits-all" approach to consignments. We will create a plan that best meets your needs and maximizes the return on your investment.

Our commission is based on the selling price of each item, decreasing the higher the selling price. While our terms are always negotiable, the following commission rates have been established, and will apply unless otherwise agreed:

When an item or collection is identified for possible consignment, the prospective consignor will be asked to provide as much descriptive information as possible, including images (e.g. photos, copies or scans). Do not, however, send any information not specifically requested. If sufficient information cannot be gathered remotely (in the case of large collections, etc.), we may request a viewing, either at the seller's residence, storage facility or place of business, Legacy Americana headquarters, or at another mutually agreed upon location. Each party shall be responsible for any travel or other expenses thus incurred.

When enough information has been gathered, and we have agreed to accept your item(s) on consignment, you will be presented with a contract. If the terms of this agreement are acceptable, you must return a signed copy within 90 days. If any portion of the agreement is unacceptable, proposed revisions must be submitted in writing within 30 days; we shall respond in writing within 30 days. If compromise has not been reached at 90 days, the contract will be withdrawn. When both parties have agreed to the terms, the consignor shall render item(s) specified in the agreement to Legacy Americana or its agent within 30 days. We shall have no obligation under the agreement until such item(s) have been rendered by the consignor.

Unless otherwise agreed, the cost of rendering consigned property to Legacy Americana is the sole responsibility of the consignor. Legacy Americana shall not be responsible for loss or damage that may occur during shipment. In addition to packing items with care, we strongly recommend insuring items for full replacement value. We will advise consignors on how best to prepare items for shipment, and of the options for safe and reliable delivery; please inquire in advance.
Once received, all consignments are authenticated and inspected for damage. Items found not to be authentic or in any way other than represented by the consignor may be refused or we may ask that the consignment terms be revised. As a general policy, we do not accept consignments of uncertain authenticity or provenance. Consignors will be liable for any false or misleading claims made about their consigned property.

Consignors may stipulate a minimum price or net return on a consignment, but the actual selling price will be determined by Legacy Americana or (in the case of items sold at auction) the buyer. The actual amount the consignor nets from a consignment may not be determined until after the sale. We reserve the right to refuse a consignment if we believe the minimum established by the consignor is unrealistically high.

Consignors may stipulate a maximum period, not less than 90 days, during which Legacy Americana is authorized to market consigned property. Unless withheld for a forthcoming auction or included in our General Catalog, most items not sold within six months will be returned to the consignor, or we may propose an alternative marketing strategy (may affect consignment terms).

Consignors are compensated for sales month-to-month. Payments are disbursed approximately 45 days from the final day of each calendar month. For example, proceeds from sales made in the month of January are disbursed to consignors in mid-March. Consignors will receive an itemized report of all sales disclosing the selling price of each item. It is not our policy to issue advances to consignors unless negotiated as part of the consignment agreement, nor may consignors borrow against sales.
Items consigned to Legacy Americana are insured against fire, theft, and any damage or breakage caused by our staff or personnel. Consignors shall be reimbursed up to 80% of retail value, or will be offered replacement with item(s) of equal or greater value.
