Terms of Use
I. Agreement
This website (www.LegacyAmericana.com and sub-domains; herein referred to as the "Website") is owned and operated by Legacy Americana LLC, of Tucson, Arizona. The following Terms of Use constitute the entire agreement between you (the "User") and Legacy Americana LLC with respect to the use of this Website, and supersede and replace all prior or contemporaneous understandings or agreements, written or oral. By accessing and using this Website, the User accepts and agrees to be bound by the Terms of Use set forth herein, as well as any applicable laws, rules and regulations. Legacy Americana LLC may at any time and at its sole discretion, modify or revise the Terms of Use by updating the text of this page.
II. Eligibility
Legacy Americana LLC offers this Website for the use of persons who may lawfully enter into and form contracts under applicable law. Use by minors is understood to be with the consent and under the supervision of a responsible adult, parent or legal guardian.

As a User, you are responsible for your own communications and are responsible for the consequences of their posting. These Terms of Use will be governed by and construed in accordance with the laws of the State of Arizona, United States of America, without giving effect to their conflict with laws or provisions of your actual state or country of residence, and by using this Website you consent to the exclusive jurisdiction of the courts of the State of Arizona, U.S.A.
XV. Severability
If any provision of this agreement shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions. Failure of Legacy Americana LLC to exercise or forbearance from exercising any rights or remedies, or failure to enforce or forbearance from enforcing, the strict performance of any provision of this Agreement, will not constitute a waiver of right of Legacy Americana LLC to exercise such rights or remedies or enforce such provision or any other provisions of this agreement in that or any other instance. Any waiver of any provision of this agreement by Legacy Americana LLC must be made in writing and signed by an authorized representative specifically referencing Terms of Use and the provision to be waived.
XVI. Revisions
The User is advised to review this page periodically for revisions. By using this Website after revisions have been posted, the User is deemed to have accepted any new requirements or prohibitions set forth. Once posted, revisions take effect immediately.
XVII. Denial of Access
We reserve the right, at our sole and absolute discretion, to suspend or terminate your right to access this Website if we learn that you have provided us with false or misleading information, interfered with other users or the administration of our online services, or violated or attempted to violate the Terms of Use.

We at Legacy Americana are committed to respecting your privacy and recognize your need for appropriate protection and management of any personally identifiable information you share with us. Legacy Americana has established this Privacy Policy so that you can understand the care with which we intend to treat your personal information.

Legacy Americana collects personal information when you register to use any of our services, or make a purchase. Conditions of Sale
The following Conditions of Sale are the entire agreement between Legacy Americana LLC, the Consignor for whom it acts as agent, and the Buyer, relative to property offered for sale by Legacy Americana LLC, and supersede and replace all prior or contemporaneous understandings or agreements, written or oral. By bidding at auction, by ordering from a catalog or sales publication, or by using the commerce areas of the Legacy Americana LLC website (www.LegacyAmericana.com and sub-domains), the Buyer accepts and agrees to be bound by these Conditions of Sale.
- Property offered for sale by Legacy Americana LLC is warranted to be authentic as stated in the Warranty of Authenticity. Except for the limited warranty contained therein, all property is sold "AS IS" without any representations or warranties as to merchantability or fitness for a particular purpose, nor whether the Buyer acquires any copyrights or patents associated with said property. All statements contained in a catalog description, or in any bill of sale, invoice or elsewhere as to authorship, period, culture, source, origin, measurement, quality, rarity, provenance, importance, historical relevance, or physical condition are qualified statements of opinion and are not representations or warranties.
- All merchandise is offered subject to availability and may be withdrawn at any time prior to sale. Prices quoted at any time prior to sale are subject to change without notice. Merchandise placed on hold awaiting payment will be available at the quoted price for a period of five (5) business days, after which time it may be re-listed, priced and sold to another customer, or otherwise disposed of. Prospective buyers may request an extended hold by making a non-refundable deposit of 15% of the total invoice, the balance due within 30 days. No merchandise will be sent on approval.
- Unless otherwise noted, only choice, excellent specimens are offered. Where condition is noted, standard grading may be employed. Material damage and/or flaws are described to the best of our ability, but all grading is subjective. For more information, please refer to our Grading Policy.
- Unless other arrangements have been made, all invoices are due within five (5) business days of receipt. Invoices not paid after 30 days are subject to a finance charge equal to 1.5% per month, in addition to other remedies available to us by law. Orders placed by mail should include payment in full. Layaway policy: Non-auction invoices of $250 or more may be paid in up to three monthly installments, with a minimum, non-refundable down-payment of 25% due upon receipt, and subsequent installments of at least 25% due each 30 days. Any balance unpaid after 90 days is subject to a finance charge, in addition to other remedies available to us by law. To arrange layaway or special terms, please make inquiry at time of purchase.
- Arizona residents must pay 6.1% sales tax. Purchases are exempt if the purchaser presents a valid Transaction Privilege Tax Exemption Certificate (Form 5000) or Exemption Resale Certificate (Form 5000A) from the Arizona Department of Revenue.
- Legacy Americana LLC accepts the following forms of payment: cash, cashier's checks, personal checks, money orders, electronic checks, and all major credit/debit cards. We do not recommend sending cash by mail, and are not responsible for loss. Personal checks may require bank clearance prior to shipment of goods. Credit/debit cards are accepted subject to the following provisions:
- Transactions are processed with the knowledge and consent of the cardholder.
- Cardholder provides full and accurate information, including name as it appears on the card, account number, expiration, verification code, billing address, and, if requested, written approval of the transaction.
- Cardholder shall give due notice of any disputed charge and allow at least five (5) business days for Legacy Americana LLC to respond before initiating a chargeback with the issuing bank. A processing fee of $50.00 (USD) shall apply to each chargeback later reversed, or cardholder will face indefinite suspension of services.
- Fraudulent use of credit/debit cards, including bogus chargebacks, will be prosecuted to the full extent of the law. This provision shall not prevent Legacy Americana LLC from seeking to obtain other legal remedies, both civil and criminal.
- Legacy Americana LLC offers delivery of merchandise in as little as 24 hours. The greatest care is taken in preparing items for shipment, to ensure they arrive in the best possible condition. To offset our costs, a fee for delivery will be added to each invoice, based on the size of the order and the destination. This fee covers freight, packaging and labor. For the convenience of customers, we have established standard rates for delivery to most destinations in the U.S. and abroad (actual costs may vary). Buyer is advised to take into consideration the cost of delivery prior to making any purchase. Delivery fees are non-refundable.
- Buyers may return merchandise for refund of the purchase price immediately upon receipt, provided item(s) are in the same condition sold and received at our facility not more than 30 days from date of invoice. Merchandise purchased at auction may be returned only if found to differ from the catalog description. For more information, please refer to our Return Policy.
- No buyer shall be entitled to any remedy, relief or damages beyond return of the purchased property or merchandise, rescission of the sale and refund of the purchase price. If Legacy Americana LLC is prevented by fire, theft or any other reason from delivering any property or merchandise to the Buyer, or a sale cannot otherwise be completed, our liability shall be limited to the sum actually paid for said property or merchandise, and in no event shall include any incidental or consequential damages.
Warranty of Authenticity
Legacy Americana warrants the authenticity of every item we sell. This means whatever you buy from us will be an original from the time period represented, not a reproduction, facsimile, or copy of later vintage. If authenticity is ever questioned by a recognized authority in the field of historical Americana (e.g. an established dealer, auction house, museum curator, author of a reference or price guide, or an official of a collectors' organization, such as APIC), the buyer may return the item for a full refund of the purchase price. This warranty is for the lifetime of ownership.
The buyer's sole remedy under this warranty shall be the rescission of the sale and refund of the original purchase price paid for the item, and this remedy shall be exclusive and in lieu of any other remedy otherwise available to the buyer as a matter of law.
Legacy Americana shall have no obligation to rescind the sale unless the buyer has obtained, at the buyer's own expense, the opinion of at least one recognized expert in the field, who is mutually agreeable to Legacy Americana and the buyer, that an item is not authentic. Items of questioned authenticity must be returned, with proof of purchase, in the condition originally sold.
The benefits of this warranty are not assignable and are applicable only to the original buyer.
Autograph Policy
All autograph material offered by Legacy Americana is covered by our lifetime warranty of authenticity, which provides that if at any time the authenticity of any item is called into question by a recognized authority, the buyer may return said item for a full refund. Although we are not autograph specialists and do not employ an authentication service, as a rule we handle only items that are (A) authentic on their face, with virtually no possiblity of forgery; or (B) sourced from the original owners and/or witnessed in person.

Our grading system is derived from grading standards for United States coins established by the American Numismatic Association. We have opted for this system in favor of one based on less precise vernacular grading terms, which can be open to wide interpretation. Moreover, we strive for consistency in grading; if two items are graded alike, it may be assumed they are in like or very similar condition.
That said, all grading is subjective. Our grading methodology is based on years of experience in the trade, but we make no claims of scientific accuracy, and recognize that no two individual graders see the same specimen the same way. Our grading is for the purpose of facilitating transactions with our customers, and otherwise carries no weight in the marketplace or outside the Legacy Americana organization.
Only specimens we consider in pristine, untouched condition, with no apparent wear or fatigue, are graded AU or UNC. Unless described as AU or UNC, it should be assumed that specimens show at least minimal wear or fatigue. Generally speaking, a specimen graded XF is a superior specimen, in choice, excellent condition, with minimal wear or fatigue. A specimen graded VF is in choice, very fine condition, with minor but noticeable wear or fatigue. A specimen graded F is in fine condition, with general wear or fatigue. Specimens graded VG or G are in good condition, but may have extensive wear or fatigue. Specimens graded Fair or Poor, the lowest grades assigned, are inferior specimens, with significant wear or fatigue.
To the extent possible, given limitations of supply, only choice, above average specimens are offered. Where no grade is assigned, or in the case of General Catalog items (example shown), the customer may assume the specimen offered will grade VF or better unless otherwise noted. This reflects a physical condition acceptable to most collectors.
When inventoried by Legacy Americana, all items are given a preliminary inspection for damage, before being approved for sale. Material damage, flaws or defects (distinguished from normal wear and fatigue) are described to the best of our ability. As a general policy, items found to have significant damage or flaws will be culled from the inventory and will not be offered through our catalogs or auctions. When a damaged item is offered, it is usually because of its uniqueness or rarity, or because a specimen in better condition is very difficult or impossible to find. Items cataloged as part of an auction or featured in the online store are carefully inspected for damage, and we will note any flaws or defects in the sales description, in addition to assigning a grade.
When multiple specimens are available, our policy is to sell the best ones first. We fill orders as though the customer were looking over our shoulder. Nevertheless, our inventory is constantly in flux and new material arrives at our warehouse daily. If the specimen received is in unacceptable condition, a replacement in better condition may be available, and may be offered in lieu of a refund.
Customers who desire specimens in pristine condition should make this requirement known prior to purchase. We make an effort to accommodate unusually discriminating buyers, but no customer shall have exclusive access to the best specimens. Further, this requirement may prevent us from filling some orders. Many of the items we sell are of considerable age and were not always well taken care of by their previous owners. Minor, natural evidence of age should be expected, and acceptable even to the most condition-conscious collector.

Return Policy
Our commitment to customer satisfaction means any item can be returned, no questions asked, for a full refund or replacement. Please notify us upon receipt of your order if you intend to return any item, and specify whether you want a refund or replacement. Returned items must be received at our facility within 30 days of invoice in the condition originally sold, and must include a copy of the invoice, packing list, or other proof of purchase showing the buyer's name. Legacy Americana is not responsible for loss or damage that may occur during return shipment, therefore we strongly recommend insuring returned item(s) for full replacement value. Buyer is responsible for all return shipping costs. Refunds will be issued according to the method of payment.

Buying Policy
Legacy Americana is constantly in search of quality historical memorabilia to serve our active clientele of private collectors and institutions. Emphasis is placed on United States election-related ephemera, but any object of historical interest will be considered, and we love the unusual. Prospective sellers are encouraged to submit their material for consideration.
We are prepared to make competitive cash offers for important single items, select groups of items, and collections of any size. We will make an effort to assist you even if you haven't yet decided to sell. There is no obligation to sell, and there is no charge for your initial consultation.
When an item or collection is identified for possible acquisition, the prospective seller will be asked to provide as much descriptive information as possible, including images (e.g. photos, copies or scans). Do not, however, send any information not specifically requested. If sufficient information cannot be gathered remotely (in the case of large collections, etc.), we may request a viewing in person, either at the seller's residence, storage facility or place of business, Legacy Americana headquarters, or at another mutually agreed upon location. Each party shall be responsible for any travel or other expenses thus incurred.
When enough information has been gathered, and in our judgment a transaction appears viable, an offer will be submitted in writing, and is good for a period of 90 days. The seller may stipulate a price, which if agreeable will be the amount of our offer; if the seller's stipulated price is deemed too high, a counteroffer may be submitted, or the item(s) refused for acquisition. If we decline to make an offer, the seller will be informed of the reason and advised on alternative means of disposing of his or her property.
Sellers are encouraged to evaluate carefully any offer, and to seek qualified, independent advice if necessary. We are not appraisers, and no offer should be regarded as the equivalent of an appraisal or an estimate of market value. While an offer remains valid, sellers are at liberty to seek competing offers from other parties not affiliated with Legacy Americana.
After an initial free consultation, a prospective seller may be billed for further consultation and advice. For hourly rates, please refer to our Explanation of Rates. Whether a prospective seller is billed for consultation shall be at the discretion of Legacy Americana, and in most cases fees are waived if a transaction is in progress. After a successful transaction is completed, the seller will be entitled to a full refund of any consultation fees associated with said transaction.
We will not engage in "bidding wars" with other prospective buyers. Once an offer has been submitted, it should be considered firm and final. If our offer is rejected in favor of a competitor's, we ask that the seller inform of the fact immediately, so the file may be closed (our offer will remain valid for 90 days, however, even if rejected).
If satisfied with our offer, the seller must provide a written acceptance within 90 days. Item(s) to be sold are thereupon rendered to a Legacy Americana associate for final inspection and approval. In the case of large collections, final inspection will be performed on location. Otherwise, seller will be provided an address to which item(s) are to be shipped. DO NOT ship to Legacy Americana headquarters unless specifically instructed to do so.
Legacy Americana shall not be responsible for loss or damage that may occur during shipment. In addition to packing items with care, we strongly recommend insuring for full replacement value (or in the amount of the offer). We will advise sellers on how best to prepare items for shipment, and of the options for safe and reliable delivery. Sellers may qualify for a full or partial refund of the cost of shipping item(s) acquired by Legacy Americana; send under separate cover copies of any shipping-related receipts.
If upon inspection item(s) are found to differ materially from the seller's description, are determined to be reproductions or forgeries, are found to have damage or flaws not before apparent, or for any reason must be declined for acquisition, the offer will be rescinded or revised. If rescinded, item(s) will be returned promptly to the seller. If revised, seller will have a period of five (5) business days to accept or reject the revised amount; if rejected, item(s) will be returned.
Items approved for acquisition are considered sold at the agreed upon price, and payment in full shall be immediately forthcoming by terms agreeable to both parties (usually check or bank draft sent via certified mail). In addition to the purchase price, seller may be entitled to reimbursement of any consultation fees and transaction-related expenses (be sure to save all receipts).

Consignment Policy
Legacy Americana is constantly in search of quality historical memorabilia to serve our active clientele of private collectors and institutions. Emphasis is placed on United States election-related ephemera, but any historical item will be considered, and we love the unusual. Prospective sellers are encouraged to submit their material for consideration.We accept consignments of important single items, select groups of items, and collections of any size. Our experts will make an effort to assist you even if you haven't yet decided to sell. There is no obligation, and there is no charge for your initial consultation.
Legacy Americana offers consignors a variety of options for marketing their material. We don't believe in a "one-size-fits-all" approach to consignments. We will create a plan that best meets your needs and maximizes your net proceeds.
Our commission is based on the selling price of each item, decreasing the higher the selling price. While our terms are always negotiable, the following commission rates have been established, and will apply unless otherwise agreed:

When enough information has been gathered, and we have agreed to accept your item(s) on consignment, you will be presented with a contract. If the terms of this agreement are acceptable, you must return a signed copy within 90 days. If any portion of the agreement is unacceptable, proposed revisions must be submitted in writing within 30 days; we shall respond in writing within 30 days. If compromise has not been reached at 90 days, the contract will be withdrawn. When both parties have agreed to the terms, the consignor shall render item(s) specified in the agreement to Legacy Americana or its agent within 30 days. We shall have no obligation under the agreement until such item(s) have been rendered by the consignor.
Unless otherwise agreed, the cost of rendering consigned property to Legacy Americana is the sole responsibility of the consignor. Legacy Americana shall not be responsible for loss or damage that may occur during shipment. In addition to packing items with care, we strongly recommend insuring items for full replacement value. We will advise consignors on how best to prepare items for shipment, and of the options for safe and reliable delivery; please inquire in advance. Once received, all consignments are authenticated and inspected for damage. Items found not to be authentic or in any way other than represented by the consignor may be refused or we may ask that the consignment terms be revised. As a general policy, we do not accept consignments of uncertain authenticity or provenance. Consignors will be liable for any false or misleading claims made about their consigned property.
Consignors may stipulate a minimum price or net return on a consignment, but the actual selling price will be determined by Legacy Americana or (in the case of items sold at auction) the buyer. The actual amount the consignor nets from a consignment may not be determined until after the sale. We reserve the right to refuse a consignment if we believe the minimum established by the consignor is unrealistically high.
Consignors may stipulate a maximum period, not less than 90 days, during which Legacy Americana is authorized to market consigned property. Unless withheld for a forthcoming auction or included in our General Catalog, most items not sold within six months will be returned to the consignor, or we may propose an alternative marketing strategy (may affect consignment terms).
Consignors are compensated for sales month-to-month. Payments are disbursed approximately 45 days from the final day of each calendar month. For example, proceeds from sales made in the month of January are disbursed to consignors in mid-March. Consignors will receive an itemized report of all sales disclosing the selling price of each item. It is not our policy to issue advances to consignors unless negotiated as part of the consignment agreement, nor may consignors borrow against sales. Items consigned to Legacy Americana are insured against fire, theft, and any damage or breakage caused by our staff or personnel. Consignors shall be reimbursed up to 80% of retail value, or will be offered replacement with item(s) of equal or greater value.

Catalog subscription
Legacy Americana publishes fully illustrated catalogs featuring vintage political collectibles. The annual subscription rate is $10.00. Customers with cumulative annual purchases of $50 or more receive a comp subscription.
Consultations Legacy Americana offers consultation services to licensed appraisers and the general public. Our specialists can assist you in identifying and evaluating your political antiques and collectibles. Our basic hourly rate is $75.00. Consultations can be performed by mail, electronically, over the phone, or we can arrange to consult with you in person. Legacy Americana does not offer appraisal services, and any values given are estimates only. Consultation fees charged to prospective sellers will be refunded if a sale is successfully negotiated with Legacy Americana or one of its affiliates.
Priority handling Our policy is to process and ship orders as they are received. Most orders will ship within one business day. Orders received before noon MST normally ship the same day; orders received after noon normally ship the following business day. Priority handling guarantees same-day shipment; the service is available M-F, subject to existing backlog and the size and complexity of the order in question. Our base rate for priority handling $25.00 per order.
Shipping Rates include packaging, labor, freight and insurance, and apply as a fixed surcharge to each invoice based on the highest class assignment of item(s) invoiced. Additional handling fees may apply for shipment of especially large, heavy or fragile items (refer to item description or inquire at time of purchase). All rates and fees paid for delivery are non-refundable unless package fails to arrive within (a) 15 business days of shipment date with Standard service, or (b) 3 business days of shipment with Expedited or Overnight service. Most orders ship within 1-2 business days of receipt of cleared payment, and often the same day. Authorized carriers: United States Postal Service (Standard and International); FedEx (Expedited and Overnight).
